A concession agreement is a partnership form when the state engages private organizations in the property or the services rendering management. At the same time, the state reserves the control over the partner’s work quality and legality. Thanks to concessions, the state fulfills its social functions, but at the same time reduces the strain on the budget.
The parties to the concession agreement are - the concessor and concessionaire.
The concessionaire creates or reconstructs the object of the concession agreement - certain property, at his own expense. Moreover, the right of ownership of this property belongs to the concessor. Further, the concessor transfers this property for rent to the concessionaire, who uses it for the purposes and in the manner established by the agreement.
How the camera operator works on the roads of the Moscow region
In 2016, the Moscow region government entered into a concession agreement with MVS Group in order to create a traffic camera recording systems for traffic violations. Its goal is to prevent violations of traffic rules and increase the level of public and anti-terrorism security in the region.
According to the agreement, MVS Group purchases, installs, and maintains traffic recording systems for traffic violations. All systems are leased by the company - they are transferred to the ownership of the Moscow region after installation. MVS Group is responsible for the operability and technical support of the entire system.
The decision about the cameras installation is made by the STSI in the Moscow region after analyzing the statistics of violations and identifying the centers of accident. At the same time, MVS Group does not take part in the camera location selection.
The company also does not participate in the review of each traffic violation and does not set fines. Data from the complexes is in a single database data, where they are checked by the "Traffic Safety of the Moscow Region selection " - the structure of the regional government. Further, the traffic police will recheck the photo materials and issue a resolution on the violation.
Thus, the operator of traffic systems cannot affect the number and size of imposed selection. And letters with notifications of traffic violations come from MVS Group, since this is a condition agreement. Moreover, the content of these letters is formed by the STSI.
